Terms of Service

These Terms of Service ("Terms") govern your access to and use of Booklyn — the website, applications, booking tools, business management tools, payment-related features, communication tools and other services we provide (together, the "Platform" or "Services").
By creating an account, accessing the Platform or using any of our Services, you agree to be bound by these Terms. If you don't agree with them, please don't use the Platform.
In these Terms, "we", "us", "our" and "Booklyn" refer to Zero Miles Per Hour Ventures, operating in Ghana. "You" or "your" refers to the individual or business using the Platform.

1 About Booklyn
Booklyn gives businesses the tools to run and grow their operations, including, where available on your plan:
- Online booking pages, walk-ins and per-staff appointment diaries;
- Class timetables, waitlists and master classes;
- Day passes and member drop-ins;
- Rentable spaces, booked by the hour or as fixed sessions;
- Memberships and class packs;
- A public directory listing;
- Customer, staff and team management, across one or several branches or businesses;
- Point-of-sale and an online shop for products and add-ons;
- Discount coupons and email/SMS marketing campaigns;
- Customer intake and consent forms;
- WhatsApp booking alerts;
- A custom domain and installable app for your own site;
- Staff payroll and business expense tracking;
- Business reports, analytics and data export; and
- Payment and transaction management, and other features we introduce from time to time.
Which of these you can use depends on your subscription plan, your own configuration, and any add-ons you've switched on.
2 Eligibility and Creating an Account
You must be legally capable of entering into a binding agreement to use the Platform. If you create an account on behalf of a business or other entity, you're confirming you have the authority to accept these Terms on its behalf, and that your use of the Platform complies with all applicable laws, regulations and industry requirements.
Some Services require an account. You agree to give accurate, complete and current information when creating and maintaining it, and you're responsible for keeping your login credentials confidential, keeping your account information accurate, everything done through your account, restricting unauthorised access to it, and telling us right away if you think it's been compromised.
You must not create an account with false information or impersonate another person or business. We may suspend or restrict an account we reasonably believe has been compromised, is being misused, or is being used against these Terms or the law.
3 Your Business and Customer Data
You may use the Platform to collect and manage information about your customers, staff and other individuals — through booking and intake forms, your online shop, point-of-sale, memberships, campaigns, WhatsApp messages, customer profiles and other features you configure.
You're responsible for having a lawful basis and any required permissions or consents to collect, use and process that information, and for making sure it's appropriate, accurate and necessary for the purpose you collect it. If you build custom intake forms, the same applies: only ask for what's necessary, relevant and lawfully collected, and never request sensitive or unnecessary information without a lawful basis and appropriate safeguards.
Where you use Booklyn to process personal data on behalf of your customers, you're generally the data controller and Booklyn acts as a data processor, depending on the nature of the processing. Our Privacy Policy explains how we process personal information.
4 Customer Communications and Marketing
The Platform may let you send email, SMS, WhatsApp messages, reminders, promotions and other customer communications. You're solely responsible for their content, recipients and timing.
Your communications must comply with applicable laws, never be misleading, fraudulent or deceptive, go only to appropriate recipients who've given any consent that's required, and never amount to spam or abusive messaging. Where required, give customers a clear way to stop receiving marketing messages.
Delivery of email, SMS and WhatsApp messages may depend on third-party providers, telecommunications networks and WhatsApp's own policies and technical limits — we don't guarantee that every message will be delivered, opened or received, and usage limits or extra charges may apply depending on your plan. We aren't responsible for interruptions, restrictions or account decisions made by WhatsApp or other providers.
We may monitor communication activity to protect our systems and prevent abuse, and may suspend messaging or an account we reasonably believe is being used for spam, fraud or unlawful communication.
5 Bookings, Walk-Ins and Day Passes
Booklyn provides the tools; the business using the Platform is responsible for the services it offers, its availability, pricing, cancellation and refund policies, customer communication, service delivery, and any dispute with its own customers. This applies equally to appointments, walk-ins and day passes recorded through the Platform.
Booklyn is a technology provider, not the provider of services listed by businesses on the Platform. A booking made through Booklyn creates an arrangement between the customer and the relevant business, unless we say otherwise. We don't guarantee that a business will honour, provide or complete any appointment or service, and businesses are responsible for the accuracy of what they enter and for complying with applicable privacy law.
6 Selling Through Booklyn
Certain features let businesses record sales, process payments, list products in an online shop, or offer recurring subscriptions and memberships to their own customers.
Payments. Payment services may be provided by third-party payment providers (for example Paystack or Hubtel), and using them may also be subject to that provider's own terms. We don't guarantee the availability or uninterrupted operation of third-party payment services. Unless we say otherwise, Booklyn isn't the seller of goods or services offered by businesses on the Platform.
Products. Businesses are solely responsible for what they sell — legality, availability, pricing, description, quality, delivery, returns and refunds — and must not sell prohibited, illegal or restricted products. We may remove listings or restrict an account where we reasonably believe products violate the law or our policies.
Subscriptions and memberships. A business offering these to its own customers is responsible for clearly communicating pricing, billing frequency, commitment periods, renewal and cancellation terms, included benefits, and its own refund policy. Where recurring payments run through a third-party provider, that provider's terms may also apply — we don't guarantee a customer will continue a subscription or that a payment will succeed.
Businesses remain responsible for their own prices, taxes, receipts, chargebacks and compliance with applicable financial and consumer law.
7 Custom Domains and Multiple Locations
Certain plans let you connect a custom domain to your booking page. You're responsible for owning or having the right to use it, maintaining its registration, giving accurate domain information, configuring the required DNS records, and making sure it doesn't infringe anyone else's rights. We don't guarantee that every domain provider or configuration is supported.
Where your plan supports it, you may also create and manage multiple branches or businesses. You're responsible for the accuracy of each one's staff, services, schedules, pricing and availability, and must not use this to create duplicate or misleading businesses for fraudulent purposes.
8 Your Booklyn Subscription
Certain Platform features require a paid subscription. You agree to pay the fees for the plan you choose. Prices, billing periods, included features and usage limits are shown before purchase or upgrade, and unless we say otherwise, subscriptions renew automatically at the end of each billing period.
You authorise the applicable payment provider to charge the payment method on your account for recurring fees. If a payment fails, we may retry it, notify you, restrict paid features, suspend the account, or cancel the subscription. We may change our pricing from time to time, with reasonable notice before it takes effect.
You may cancel from your account at any time. Cancelling stops future renewal but doesn't automatically entitle you to a refund for a billing period already under way, except where the law requires it or we say otherwise — paid features generally stay available until the end of the current billing period. Subscription fees are otherwise non-refundable for a partially used billing period, without limiting any right you have under applicable consumer protection law.
9 Your Content and Our Intellectual Property
You keep ownership of the content you upload or create through the Platform — your business information, logos, images, product and service details, customer information, forms and marketing content. You grant Booklyn a limited, non-exclusive licence to host, store, process, reproduce and transmit that content only as needed to provide, maintain, secure and improve the Services. We don't claim ownership of your business content.
Booklyn and its underlying technology, software, design, branding and features are owned by or licensed to us. Except as these Terms expressly allow, you may not copy or reproduce the Platform, reverse-engineer it, resell or sublicense it, create derivative works, circumvent usage limits, use it to build a competing service through unauthorised means, or remove our proprietary notices.
10 Acceptable Use
You must not use the Platform to commit fraud, facilitate illegal activity, send spam or malicious communications, phish or impersonate others, distribute malware, attempt unauthorised access, interfere with the Platform, abuse our systems or APIs, collect personal information unlawfully, sell prohibited goods, infringe intellectual property, harass or threaten others, circumvent security controls, or otherwise break the law.
We may suspend or terminate access where necessary to protect the Platform, our users or third parties.
11 Third-Party Services
The Platform integrates with third-party services — payment, communication, domain and analytics providers among them. Using those services may also be subject to their own terms and privacy policies. We aren't responsible for the availability, security or policies of third-party services we don't control.
12 Availability, Backups and Disclaimers
We aim to keep the Platform reliable and secure, but we don't guarantee it will always be available, uninterrupted, error-free, secure against every possible threat, or compatible with every device. It may occasionally be unavailable for maintenance, upgrades, technical issues, security incidents or circumstances beyond our reasonable control.
We take reasonable measures to protect and maintain your business data, but you remain responsible for keeping your own records and backups of anything important to your business — we don't guarantee data can always be recovered after accidental deletion, technical failure or a security incident.
The Platform is provided on an "as available" basis. We don't guarantee it will generate a particular number of bookings, customers, sales or revenue, or guarantee the performance, quality or legality of any business, service, product or transaction conducted through it. You're responsible for your own business decisions and for what you provide to your customers.
13 Suspension and Termination
We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, use the account for fraud or unlawful activity, present a security risk, abuse the Platform, or where we're required to by law or are discontinuing the relevant Service. Where reasonably possible, we'll give notice first, unless immediate action is required.
After termination, your right to use the Platform ends. We may retain certain information for legitimate business, legal, security, accounting or regulatory reasons — export any data you need before closing your account.
14 Liability and Indemnification
To the maximum extent the law allows, Booklyn and its owners, employees and service providers won't be liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Platform. Where liability can't legally be excluded, ours will be limited to the maximum extent the law allows.
You agree to indemnify and hold Booklyn, its owners, employees and service providers harmless from claims, losses and expenses arising from your violation of these Terms, unlawful use of the Platform, your products or services, your customer relationships, your marketing communications, or your breach of anyone's rights or applicable law.
15 Changes to These Terms and Governing Law
We may update these Terms from time to time. When we make a material change, we'll try to let you know through the Platform, email or another reasonable method. Continuing to use the Platform after updated Terms take effect means you accept them.
These Terms are governed by the laws of the Republic of Ghana, unless applicable law requires otherwise. Any dispute arising from them is subject to the jurisdiction of the appropriate courts of Ghana, subject to any applicable alternative dispute resolution requirements.
